I. General Information.
A. Purpose. This request for proposal (RFP) is to contract for legal services to be provided to Wallowa County
B. Who May Respond. Only attorneys who are currently licensed to practice law in Oregon, or law firms including such attorneys, may respond to this RFP.
C. Instructions on Proposal Submission.
1. Closing Submission Date. Proposals must be submitted no later than 3:00pm on Friday October 6, 2023.
The County Legal Counsel performs a variety of legal services for the Board of Commissioners and all County departments relative to civil matters. The legal services performed are in such varied fields as land use, bankruptcy, assessment and taxation, torts, contract, employment and labor law, real property, and municipal law.
II. SCOPE OF SERVICES. The Offeror shall be readily available to perform the following legal services, as requested by the Board of Commissioners and/or Administrative Director.
1. Review, draft, and negotiate contracts and leases.
2. Advise on government grant and contract issues.
3. Attend Board of Commissioner meetings remotely as necessary. There may be times when the County will need the Offeror on-site.
4. Advise on responses to subpoenas, court orders, and request for information from third parties.
5. Defend lawsuits, administrative claims, or other legal claims.
6. Conduct litigation as necessary.
7. Review personnel, and County policies as needed.
8. Interprets Federal, State and County legislation, statutes, rules, and regulations; revies and makes recommendations of proposed policy or procedural changes.
9. Researches, studies and interprets the application of laws, court decisions and
other legal authorities and precedents; prepares legal opinion, or memoranda briefs.
10. Although the County has other legal counsel for labor and employment matters, including union negotiations, the County may request your involvement.
11. Other legal services as needed such as foreclosures.
Although it is preferable for an attorney or firm to submit a proposal covering all of the above areas, Wallowa County will consider proposals for subsets of these areas.
Ill. PROPOSAL CONTENTS. The offer, in its proposal, shall, at a minimum, include the following,
A. Legal Experience. The Offeror should describe its legal experience, including the names, addresses, contact persons, and telephone numbers of at least three clients, preferably including clients similar to Wallowa County. Experience should include the following categories:
1. Experience advising local governments.
2. Experience in contract and labor laws
3. Degree from an accredited law school
4. Five years' experience in Public Law, or satisfactory equivalent
B. Organization, Size, Structure, and Areas of Practice. If the Offeror is a firm, it should describe its organization, size, structure, areas of practice, and office locations(s). Indicate, if appropriate, if the firm is a small or minority/owned business. Also include a copy of Equal Opportunity policy if the firm has one.
C. Attorney Qualifications. The offeror should describe the qualifications of attorneys to be assigned to the representation. Descriptions should include:
a. Professional and education background of each attorney.
b. Overall supervision to be exercised.
c. Prior experience of the individual attorneys with respect to the required experience listed above. Only include resumes of attorneys likely to be assigned to the representation. Education, position in firm, years and types of experience, and continuing professional education will be considered.
D. PRICE. The Offeror's proposed price should include information on the hourly billing rates of each attorney or other legal staff who is expected to work on this representation and charges for expenses, if any, such as travel, legal research,
copies, and faxes. Wallowa County reserves the right to negotiate with the Offerer on the structure of the billing.
IV. PROPOSAL EVALUATION
A. Submission of Proposals. All proposals shall include an original and three copies.
B. Evaluation Procedure and Criteria. Wallowa County Board of Commissioners, Administrative Service Director and appropriate staff will review proposals and make recommendations to the Board of Commissioners for final approval. The Board of County Commissioners may request a meeting with some qualified Offerors prior to final selection. Proposals will be reviewed in accordance with the following criteria:

1. Proposed approach to scope of work.
2. Level of experience of the individuals(s) identified to work on this matter.
3. The Offeror's experience with similar clients and legal matters.
4. Response from references.
5. Cost.
6. Interviews, if conducted.
