City Action Needed on Condo Defect Law Reform
Over the years, cities and other partners have made multiple attempts to address condominium liability reform. On April 7, HB 3746 will receive a second hearing in the House Committee on Housing.
Condo defect liability reform is facing steep opposition to passage. City officials are urged to contact their state representatives and ask them to support HB 3746.
The bill addresses construction defects in condominium developments and removes barriers to condo development in Oregon. It also strikes an appropriate balance between consumer protections for condominium owners and a developers’ ability to expand production of this key entry-level homeownership type.
Oregon has long been behind in homeownership rates and continues to fall behind other states. Condominiums are a vital, naturally occurring source of affordable homeownership, which assures long term stability for our communities. Condo defect law reform is key to ensuring that Oregon can build a variety of homes for rent and purchase. Currently, condos are underbuilt in Oregon, due in large part to an overly permissive condo defect law which makes it far too easy to sue, ultimately making condos riskier to build and buy than a traditional single-family home.
