Governor Releases FAQ on Executive Order Addressing Project Labor Agreements
On December 19, Governor Tina Kotek signed Executive Order 24-31 (EO) requiring the use of project labor agreements (PLAs) for state construction projects. The EO was unclear as to its applicability to municipal construction projects, specifically those that utilize state funding.
The LOC, along with several state agencies, followed up with the governor’s office to better understand how the EO and the requirement for a PLA apply specifically to local government projects.
As a result of LOC and state agency outreach, Governor Kotek’s office recently provided a document answering Frequently Asked Questions on EO 24-31. This FAQ document answers questions and specifically clarifies that local projects are not covered by the order - even if state funding is utilized. This means that cities that received state funds for infrastructure projects under SB 1530, or receive shared revenue from the State Highway Fund for local transportation projects, are not subject to the EO. The EO is largely intended to apply to state-owned facilities such as state highways.
