Measure 114 Adjustment Bill Moves

Legislation that would address the legal challenges to the implementation of Ballot Measure 114 (M114) was amended and voted out of the Senate Judiciary Committee this week.  The bill now advances to the Joint Ways and Means Committee.

SB 348 repeals and places M114 with requirements similar to the ballot initiative, but phases in permitting requirements in beginning July 1, 2024. As with M114, residents wishing to purchase a firearm will have to apply for a permit with a police chief or sheriff. To obtain the permit, a person will have to pass a criminal background check, have taken a firearm handling class, and meet similar requirements necessary to obtain a concealed weapons license. Under SB 348, city police departments would be required to conduct screenings and fingerprinting. 

M114 was passed by voters in last November and contains permitting requirements similar to SB 348, but on a different timeline. However, M114 is currently tied up in court proceedings and has not taken effect. The inability of state and local governments to implement the measure as passed was a component of those legal challenges. SB 348 is expected to receive additional discussion in the Ways and Means Committee but is not currently scheduled.
