Preemption on Long-Term Care Regulation Heard in Committee
Legislation has been introduced that would preempt a city or other local government from licensing or enforcing ordinances specific to the regulation of long-term care facilities. HB 2397, sponsored by Representative Rachel Prusak (D-West Linn), also includes the creation of a fund to support pilot programs to address the efficient use of emergency medical services (EMS) for long-term care facilities. The legislation was introduced partially in reaction to efforts by McMinnville to regulate facilities in their city after a pattern of inappropriate use of the city’s EMS services for non-emergency use and medical care that should have been provided by the care facility. The LOC testified with concerns on the bill, indicating support for the creation of creative pilot programs, but with objections to the preemption.
