Clean Diesel Legislation Advances
The Joint Committee on Ways & Means Subcommittee on Capital Construction amended and passed legislation Wednesday to implement clean diesel standards for medium and heavy-duty trucks. HB 2007 now moves to the Joint Committee on Ways & Means for further consideration.
The bill, as introduced, included statewide requirements to phase-out pre-2007 engines for heavy-duty trucks (defined as weighing greater than 26,000 pounds) and pre-2010 engines for medium duty trucks (those weighing between 14,000-26,000 pounds). However, the current version of HB 2007 largely limits the phase-out requirements to Washington, Multnomah and Clackamas counties. The bill will require heavy-duty trucks to have engines with a model year of 2007 or newer (or be retrofitted) by the year 2029. Medium-duty truck engines must be model year 2010 or newer (or be retrofitted) by 2029. In addition, the Oregon Department of Transportation (ODOT) will be prohibited from issuing a registration, as of January 1, 2023, for heavy-duty or medium-duty trucks with engines that are 1996 or older. HB 2007 also prohibits ODOT from issuing a certificate of title, after January 1, 2025, for any medium-duty truck with a 2009 or older engine, or for a heavy-duty truck with a 2006 or older engine.
The bill includes exemptions from the county-specific and statewide phase-out requirements, including an exemption that was requested by the LOC and other local governments, for emergency vehicles and ambulances. Other exemptions include farm vehicles, campers, motorhomes, recreational vehicles, antique vehicles and heavy-duty trucks that are operated for 5,000 or fewer miles on highways during a calendar year. Finally, HB 2007 will require the Oregon Department of Environmental Quality to implement specific priorities when awarding grants involving the state’s VW Mitigation Settlement Funds. Approximately $53 million must be expended to support clean-diesel projects and conversions by October of 2027.
