PERS Seeks Comment for Rule Making on Side Accounts & Employer Incentive Fund

For LOC members interested in Public Employee Retirement System (PERS) side accounts or the system’s Employer Incentive Fund (EIF), public comment opened on July 24 and will close August 21. A rule making hearing has been scheduled for August 18 at 2 p.m.

PERS is seeking to codify their transition plan as a significant number of side accounts opened between 2002 and 2007 reach their 20-year end date on December 31, 2027. The proposed rules specifically:

  • Establish a process for administering side accounts that are reduced to zero or a negative balance during the amortization period;
  • Clarify the treatment of employer reporting submitted after a side account becomes inactive;
  • Establish procedures for the disposition of a remaining credit balance at the conclusion of a side account amortization schedule; and
  • Clarify that no administrative fee will be charged for any calendar year following the last calendar year in which an amortized amount was transferred from the side account to an employer reserve account.

The proposed Employer Incentive Fund (EIF) rules:

  1. Establish a process for administering partially matched applications; and
  2. Clarify that employers are not required to submit the unmatched portion of an approved UAL lump-sum payment commitment while that unmatched portion remains on the waiting list.
