State Shared Marijuana Tax Certification Bill Advances

The LOC requested state marijuana tax certification efficiency legislation, and this week HB 3067 passed both the House and the Senate Finance and Revenue Committee.  Cities receive 10% of state marijuana taxes, but each city must certify quarterly that it does not ban any of the marijuana license types in its city to receive a share.  HB 3067 will change the certification requirement from a quarterly to an annual requirement.  Cities presently receive a Survey Monkey email with a certification form every three months from the Oregon Liquor Control Commission, but that email often gets lost as spam or falls through the cracks when cities have  personnel changes. With HB 3067, the plan next year will be to include the marijuana certification with the other state shared revenue certifications (for liquor, cigarette, and highway trust fund revenue distributions) that are due annually on July 31 to the Oregon Department of Administrative Services (DAS).  This will provide a more efficient and less stressful process for all, and was a request of the LOC’s Finance and Tax Committee.  Cities that change their status after certification will be responsible for updating DAS.
