Oregon Court of Appeals Rejects Stay of Vaccine Order
Citing “… a lack of reasonable likelihood of success…” Oregon Court of Appeals Appellate Commissioner Theresa Kidd refused to grant a temporary stay of enforcement this week of the Oregon Health Authority’s administrative order mandating the COVID-19 vaccine for healthcare workers, firefighters and state employees. As a result, employees, officials, and volunteers must be vaccinated against COVID-19, or receive a religious exemption by October 18. Plaintiffs in the case had asked the court to delay the mandate until the courts had reviewed the merits of the challenge, however Commissioner Kidd found little chance they would prevail and a potential for public harm if the stay were granted.
The ruling applies to vaccine orders issued by Governor Kate Brown, and is not relevant to pending federal vaccine regulations expected from the U.S. Department of Labor in the coming weeks.
